UCPR 51.50 does not authorise security for costs on applications for leave to appeal in the NSW Court of Appeal; the power must be sourced in the court's inherent jurisdiction. The inherent jurisdiction to order security on leave applications is exceptional but not confined to abuse of process — relevant factors include prospects of success, the applicant's financial position, the amount in dispute, and the nature of the hearing. Courts are not bound by solicitors' cost estimates when fixing quantum.
