Vigilante motive for a planned home invasion involving violence is not mitigating and may be aggravating; courts should give no countenance to such conduct regardless of the offender's grievance. Subjective factors used to justify departure from the standard non-parole period in fixing the head sentence must not be double-counted when varying the statutory ratio under s 44(2) of the Crimes (Sentencing Procedure) Act 1999. A non-parole period must reflect all purposes of punishment including denunciation, general deterrence and retribution.
