When assessing objective seriousness for standard non-parole period purposes, a sentencing judge must describe the extent or degree to which the offence departs from the mid-range; it is sufficient to indicate the offence was significantly, slightly, or substantially above or below mid-range, or at the top or bottom of the range. A plea of guilty does not reduce objective seriousness. The NSWCCA retains a residual discretion to dismiss a Crown appeal despite demonstrated sentencing error where re-sentencing would interfere with a well-advanced rehabilitation process.
