When sentencing a young offender who also suffers from mental illness, the considerations applicable to youth (emphasis on rehabilitation over deterrence) and those applicable to mental illness (reduced weight on general deterrence) are not simply cumulative; the weight to be given to general deterrence cannot be determined by applying only one set of considerations. The violence of an offence does not, of itself, establish that a juvenile was acting as an adult. Sentencing statistics do not determine the top of the sentencing range; the maximum penalty set by the legislature does.
