A second application for extension of time to appeal against sentence after a previous appeal has been dismissed on the merits will be refused unless the applicant advances convincing reasons for delay, explains why the matters were not raised previously, demonstrates that the grounds are truly different from those previously considered, and shows the grounds are likely to succeed. Section 58(1) of the Constitution of Queensland 2001 does not confer additional criminal appellate jurisdiction beyond ch 67 of the Criminal Code.
