A development application under the IPA that involves State resources must be accompanied by evidence that positively records the chief executive's satisfaction that the development is consistent with an allocation of, or entitlement to, the resource; mere completion of identifying details on the approved form without a statement of satisfaction is insufficient. Registered native title claimants whose rights remain undetermined are not 'owners' under the IPA and their consent is not required for a development application. The NTA's future act provisions, including s 24MD(6A) procedural rights, do not apply absent proof that native title rights actually exist over the relevant land. Even if NTA procedural requirements are not met, this does not invalidate a development approval under State law — it only means the approval does not affect native title.
