The case confirms that a stay of execution pending appeal will be refused where the applicant cannot demonstrate a good arguable case on appeal. Where an occupant's right to possession derives from a company that has consented to an order delivering up possession, and that consent order has not been appealed, the occupant has no lawful entitlement to remain in possession as against the registered mortgagee. A prior professional association between a judge and a party approximately 25 years earlier cannot conceivably give rise to a reasonable apprehension of bias.
