The court's inherent power to stay orders extends to staying orders other than the decision directly subject to the leave application, where necessary to prevent the appeal being nugatory. A stay of disclosure orders for commercially sensitive documents may be granted in qualified form, permitting disclosure to external legal representatives while restricting access by in-house personnel of a trade rival, to balance the applicant's risk of irretrievable prejudice against the respondent's need to prepare for trial.
