For unlawful stalking under s 359B of the Criminal Code (Qld) without circumstances of aggravation, threats or acts of violence, sentences of 18 months imprisonment or longer are generally reserved for cases involving circumstances of aggravation, usually threats of violence. A wholly suspended sentence of 3 months was appropriate where the offender had no criminal history, ceased offending when spoken to by police, and eventually pleaded guilty, notwithstanding the serious and persistent nature of the defamatory conduct over two and a half months.
