Where an offender's mental disorder bears substantially upon moral culpability and there is a substantial causal relation between the disorder and the offending, the sentencing purposes of general deterrence, punishment and denunciation assume much less significance, even for serious stalking offences involving threats of violence against children. A custodial sentence cannot be justified by personal deterrence or community protection where the risk of reoffending is low and rehabilitation is best promoted in the community.
