The R v Quick principle that imprisonment should follow for sexual offences against children absent exceptional circumstances does not apply where the complainant is aged 16 or over. For such offences, s 9(2)(a) of the Penalties and Sentences Act 1992 (Qld) requires imprisonment to be imposed only as a last resort, because s 9(5) only excludes the application of s 9(2) for sexual offences against children under 16. However, this does not preclude imprisonment where aggravating features such as violence or breach of trust are present.
