A personality disorder (borderline personality disorder/complex PTSD) arising from childhood sexual abuse can constitute 'unsoundness of mind' under s 29 of the Limitation of Actions Act 1974 (Qld), even where the claimant can perform ordinary life functions, provided the condition prevents the claimant from formulating, sustaining, and effectively pursuing a compensation claim. Transient periods of amelioration do not remove the statutory protection. When assessing whether 'all reasonable steps' were taken to discover material facts under s 30(1)(c), the applicant's actual psychiatric condition must be taken into account.
