For dangerous operation of a motor vehicle involving the deliberate use of a vehicle as a weapon against an individual, 18 months imprisonment is at the high end but within the proper range, particularly where the offender is a mature adult. Cases involving police chases are of limited assistance as comparators for such offending. The Court of Appeal's earlier indication in Tufuga & Kepu that 12 months was 'towards the lower end of the applicable range' for less aggressive vehicular intimidation, and the indication in Theuerkauf that three years would have been appropriate for driving at and striking a victim, inform the sentencing range.
