Evidence adduced in examination in chief solely to bolster an expert witness's credibility by reference to a prior court commission is inadmissible, but its admission will not necessarily result in a miscarriage of justice where the trial judge gives appropriate directions and the evidence does not suggest any prior determination of the issues. The defence of diminished responsibility under s 304A of the Criminal Code 1899 (Qld) may be rejected by a jury where there is evidence of pre-planning and prosecution experts do not conclude that the defendant's capacity to control her actions was substantially impaired.
