Under the Building and Construction Industry Payments Act 2004 (Qld), a payment claim may be served at any time on or after the reference date, not only on the reference date itself. A payment schedule that makes payment conditional or states only estimated amounts for negotiation does not comply with s 18(2)(b). Prolongation costs for periods after the date of the payment claim are not recoverable, but their inclusion does not invalidate the entire claim.
