The possibility of a remedy against a worker's legal adviser is a relevant consideration on an application to re-open a case before a workers compensation tribunal, but great caution should be exercised in attaching weight to it, particularly where there is no direct evidence of the likelihood of success of such action. The possibility of alternative proceedings (including reconsideration under s 62(2) of the Workers Rehabilitation and Compensation Act 1988 (Tas)) is also a relevant consideration going to the degree of prejudice to the opposing party.
