Where a concealed weapon is used to inflict serious injury, an immediate and substantial term of imprisonment must ordinarily be expected, particularly where there is a degree of premeditation. However, on a Crown appeal against sentence, an uncommon combination of intervening circumstances — including the respondent's period of liberty since sentencing, serious intervening injuries making prison more onerous, and double jeopardy — may lead the Court to decline to exercise its discretion to intervene even where the sentence is below the applicable range.
