A Crown appeal against one co-offender's sentence will be constrained by parity with unappealed co-offender sentences, even where the Crown contends the unappealed sentences were themselves inadequate. The decision to wholly suspend a sentence of imprisonment will rarely render an otherwise adequate sentence manifestly inadequate, particularly where delay and demonstrated rehabilitation support suspension. The Court signalled that sentencing practices for recklessly causing serious injury may be inadequate relative to the 15-year maximum penalty.
