The objective business purpose test from Newton v FCT and the choice principle from Gulland do not apply to s 75JDA(1)(b) of the Stamp Act 1921 (WA). An arrangement constitutes a duty avoidance arrangement under s 75JDA(1)(b) if one of its purposes (not merely incidental) is the reduction of stamp duty, even if the arrangement satisfies all requirements for exemption under s 75JB. The materiality of information for s 75JD(4) claw-back purposes is assessed at the time of the application for exemption, not after the exemption is granted, and information is material if it is both relevant and significant in the sense of being capable of influencing the outcome.
