The 'reasonable prospect of succeeding' test in the Supreme Court (Court of Appeal) Rules 2005 (WA) applies to appeals under s 43 of the Children's Court of Western Australia Act 1988 and is to be construed consistently with the same phrase in s 27(2) of the Criminal Appeals Act 2004 (WA). Grounds of appeal that are discursive and fail to identify error will not satisfy the test for leave to appeal from interlocutory decisions.
