The double jeopardy principle has no application to the re-sentencing of an offender after a successful offender appeal; on re-sentencing, there is no sentencing principle requiring a lower sentence than was first imposed, and the re-sentencing judge's obligation is to impose a sentence according to law. A total discount of approximately 52.8% from a starting point for a guilty plea and assistance to authorities was held to be very substantial and not indicative of manifest excess for possession of 593 MDMA tablets with intent to sell or supply.
