Where a workers' compensation claimant has pursued a statutory appeal to an Appeal Panel which confirms the original medical assessment, judicial review must be directed to the Appeal Panel's decision, not the original specialist's decision. A challenge to the original decision can only be brought if the matter was not and could not reasonably have been raised before the Appeal Panel and remains relevant. The adequacy of the specialist's reasons is assessed by reference to their statutory purpose of enabling the claimant to decide whether to appeal; once that purpose is fulfilled, any inadequacy is no longer material.
