Where undercover police operations yield recorded conversations containing admissions of uncharged criminal conduct and propensity for violence that are not relevant to the charged offences, such evidence is wholly prejudicial and inadmissible. Trial counsel's deliberate failure to object to such evidence may constitute incompetent representation warranting a new trial, even where the decision was tactical, if the prejudicial material could have been excluded while admitting the relevant portions of the conversations.
