Body mapping evidence purporting to detect anatomical features through clothing (including balaclavas) in poor quality CCTV footage is inadmissible under s 79 of the Evidence Act 1995 where the expert cannot demonstrate that the observations are based on specialised knowledge rather than lay observation. Where an accused is charged with receiving stolen property in the alternative to stealing, and the evidence is equally consistent with stealing as with receiving, a conviction for receiving is unreasonable.
