A sentencing judge is not required to rule on objections to a Statement of Facts where no ruling is sought by the defence. Evidence of an offender's involvement in surrounding circumstances may be used to assess credibility and set context for sentencing without breaching the De Simoni principle, provided it is not used as a circumstance of aggravation warranting conviction for a more serious offence.
