In the absence of evidence from an offender who has pleaded guilty to an offer to supply drugs, the facts of the offer should be taken at face value — that the offender intended to supply and had the capacity to do so. Where an offender is engaged in an ongoing course of wholesale drug trafficking and provides samples in connection with an offer, a sentencing judge is entitled to find beyond reasonable doubt that the offender had access to and was in a position to supply the offered quantity. The standard non-parole period remains a 'legislative guidepost' following Muldrock.
