A single judge of the Court of Criminal Appeal cannot review a bail decision of a Supreme Court judge under s 45(3) of the Bail Act 1978 absent rules made under the Supreme Court Act 1970 permitting such review. The test for bail pending appeal under s 30AA requires grounds of appeal virtually certain to succeed, assessable from the material without detailed argument. Practical matters such as imminent release, difficulties preparing an appeal in custody, and delay in hearing the appeal do not of themselves constitute special or exceptional circumstances.
