Under s 30AA of the Bail Act, a ground of appeal that is merely arguable, or even one with a reasonable prospect of success, is insufficient to establish 'special or exceptional circumstances' for bail pending appeal. The ground must be certain or near-certain to succeed. Where the non-parole period extends well beyond the likely appeal hearing date, the delay in hearing the appeal cannot itself constitute special or exceptional circumstances.
