Different verdicts against co-accused in a joint criminal enterprise are not necessarily inconsistent where the evidence supports different findings as to each co-accused's foresight of the acts of another participant. A sentencing judge's assessment of objective seriousness is reviewable on House v The King principles and will not be disturbed unless clearly wrong. Even where a Crown sentence appeal succeeds on the merits, the Court retains a discretion not to intervene where the offender has already been released on parole and is complying with conditions.
