A probation order cannot operate concurrently with a sentence of imprisonment longer than one year under s 92(1)(b) of the Penalties and Sentences Act 1992 (Qld), but probation can be combined with a suspended period of imprisonment provided the period actually served does not exceed one year. For indecent treatment of a child under 16 involving oral sex with force and threats, an effective global sentence of two years imprisonment (suspended) with probation is appropriate where there is no prior sexual offending, an early guilty plea, and significant extra-curial punishment.
