Mere presence at the scene of an opportunistically committed offence, where the meeting was by chance and the offence was not premeditated, does not constitute 'deliberate' or 'intentional' presence sufficient to establish aiding under s 7(1)(c) of the Criminal Code 1899 (Qld), even where the bystander fails to leave or discourage the offending. A lies direction is not required where the prosecution does not rely on lies as evidence of guilt and there is no real danger the jury would reason from lies to guilt.
