Where an offender is sentenced for multiple offences and only some attract a serious violent offence declaration under Part 9A of the Penalties and Sentences Act 1992 (Qld), the head sentence on the SVO-declared offence must not be increased to reflect non-declarable offending, as this improperly subjects the offender to the 80% parole eligibility requirement for all offences. The appropriate approach is to impose separate sentences with cumulative terms for non-SVO offences, with parole eligibility reflecting the distinction. The maximum penalty for dangerous operation of a motor vehicle causing death is not the starting point for sentencing vehicular manslaughter.
