For dangerous driving causing death while adversely affected by alcohol involving prolonged dangerous driving, multiple deaths, severe intoxication (.237% BAC), and no remorse at the time, a head sentence of nine years (where the maximum is 14 years) is at the lower end of the appropriate range. A 10-year sentence would have been justified. Where the head sentence is already at the lower end of the range, the allowance for a guilty plea and late remorse by way of a PPCBR recommendation must be modest. The Director of Public Prosecutions should consider charging manslaughter rather than dangerous driving causing death in the most serious cases.
