A sentence of three years' imprisonment for stalking with violence under s 359E(3) of the Criminal Code 1899 (Qld) (maximum seven years) is within range where the stalking, though short in duration, is intense, accompanied by actual and threatened violence, committed in conjunction with burglary, and committed while on parole for offences of violence. When setting a parole eligibility date for a cumulative sentence imposed for schedule 1 offences committed while on parole, the sentencing judge is not required to set the date at the halfway point of the total imprisonment period, and it is not unreasonable to contemplate that the offender should serve out the existing term before becoming eligible for parole.
