An insurer exercising an option to repair under an insurance policy must communicate that election in unqualified and unequivocal terms. A purported election that is conditional upon the insured assuming obligations not contemplated by the policy (such as instructing the repairer, signing an authority to repair, or agreeing to sign a release) is not a valid election. The insurer cannot impose on the insured obligations beyond those arising under the policy as a condition of its election.
