Misalignment of components attached to a vehicle part (such as seats attached to a cabin floor pan) does not constitute 'damage' to that part for the purposes of the non-repairable damage indicators in reg 83C(1)(c). Similarly, suspension alignment discrepancies correctable by adjustment do not constitute 'damage to the suspension'. Where a motor vehicle policy provides for a 'cash settlement up to the limit of the sum insured', this is an indemnity for actual loss, not an entitlement to the agreed value. An insurer who fails to elect within a reasonable time breaches an implied obligation, but the insured must still prove causation to recover consequential losses such as storage costs.
