An employee who is required by the employer to accept a substantial pay cut in breach of a fixed-term contract has reasonable cause to make public statements criticising the employer's conduct, and such statements do not breach any implied term of trust and confidence. The 'reasonable cause' qualification is an essential element of the implied term. A wrongful dismissal terminates the employment relationship but does not automatically terminate the contract of employment, which remains on foot until the employee accepts the repudiation.
