Where the delay in bringing a testator's family maintenance claim is not unduly long and the estate remains undistributed, ignorance of the right to claim during the six-month period, followed by a prompt application once the right becomes known, will usually be a sufficient explanation for the delay. The respondent's stress caused by the making of the claim itself, rather than by its lateness, does not constitute material prejudice for the purposes of the extension of time discretion.
