Where maximum penalties have increased since the date of offending, the sentencing court must have regard to the sentencing range applicable at the time of offending, but where that historical range cannot now be ascertained, awareness of the relevant historical maxima suffices. Delay of decades between offending and sentencing does not necessarily result in significant leniency where the offender has benefited from living without conviction while victims suffered ongoing impacts.
