Where a sentencing judge imposes a sentence exceeding the maximum penalty on one count due to being misinformed by the prosecution, the appellate court will re-sentence on that count only and will not re-open the sentencing discretion on other counts where no error is demonstrated. The principle in Ludeman v R [2010] VSCA 233 at [82] governs the scope of re-sentencing on appeal.
