Under s 55(9A) of the Road Safety Act 1986 (Vic), the requirements to 'accompany' and to 'remain' are two discrete requirements, not components of a single composite requirement. A motorist who refuses to accompany a police officer to a place for the purpose of furnishing a blood sample commits an offence under s 49(1)(e) without the need for the officer to have informed the motorist of the requirement to remain or the 3-hour temporal limitation. However, the requirement to remain must, when made, include both the purpose and the temporal limit.
