Where the Crown relies on lies in a record of interview as evidence of consciousness of guilt, the trial judge must precisely identify each lie and direct the jury to apply the Edwards requirements to each separately. A direction that refers generally to the accused 'downplaying' the assault, without precisely identifying which statements constitute the lies relied upon, is apt to mislead the jury into treating the whole interview as consciousness of guilt evidence and will be productive of a miscarriage of justice. The Ciantar four-step process should be followed from the outset of the trial.
