Orders for cumulation in sentencing serious sexual offenders must give real weight to the presumption of cumulation under s 6E of the Sentencing Act 1991, and the totality principle cannot be applied as if s 6E were not on the statute book. The compromise of a victim's compensation claim under s 85B is of limited relevance to sentencing and may not be a relevant sentencing consideration at all, particularly where remorse has already been found on other grounds. Sentences for child sexual offences must adequately reflect the serious and lasting effects on victims and their families.
