The principles governing suspension of enforcement under s 15 of the Civil Judgments Enforcement Act 2004 (WA) are not materially different from those previously applicable to stays of execution. A conditional suspension order requiring payment into court or provision of security is appropriate where there is a real risk the judgment sum would be irrecoverable but the appellant's own financial position is uncertain. Security for costs on appeal need not provide a complete indemnity and should reflect the nature and scope of the appeal.
