Under s 46(1) of the Construction Contracts Act 2004 (WA), SAT review is available only where an adjudicator dismisses an application under s 31(2)(a), not where the adjudicator declines to dismiss and proceeds to determine the application on its merits. A party aggrieved by an adjudicator's failure to dismiss must seek judicial review for jurisdictional error rather than SAT review. Section 46(3) does not exclude judicial review for jurisdictional error.
