Section 26(4) of the Proceeds of Crime Act 2002 (Cth) requires only that the court 'consider' an application for a restraining order without notice — it does not require the court to 'finally determine' the application ex parte. The court retains power under s 26(5) to direct the DPP to give notice to the property owner before final determination. Even if the Act required ex parte determination, the s 42 revocation procedure provides an adequate inter partes remedy that is compatible with Ch III of the Constitution, distinguishing the position under the Criminal Assets Recovery Act 1990 (NSW) considered in International Finance Trust.
