The common law rule prohibiting evidence of jury deliberations applies to statements made between jurors about extraneous information received from third parties, and such statements cannot be used even as a foundation for court-ordered investigation into potential extrinsic irregularities. Section 79C of the Evidence Act 1906 (WA) cannot be used to tender documentary evidence of jury deliberations because the precondition of admissible direct oral evidence is not met. Whether Australian law recognises a residuary discretion to depart from the jury secrecy rule where sufficiently compelling reasons are shown remains an open question.
