The exclusionary provision in s 5A(1) of the SRC Act applies only to action taken in respect of the administration of the employer-employee relationship (such as appraisals, discipline, counselling, and suspension), and does not extend to operational actions forming part of the employee's ordinary duties and tasks. Organisational restructuring, teleconferences reporting on branch performance, distribution of customer survey results, and supervisory visits are operational matters forming part of employment, not 'administrative action taken in respect of the employee's employment'. The non-exhaustive examples in s 5A(2) cannot be used to expand the meaning of the exclusion beyond its proper construction.
