Orders issued under s 124 of the Local Government Act 1993 must be expressed as present orders requiring compliance, not in terms of futurity or conditionality. Use of language such as 'proposed order', 'the order will be given', or 'the order will require' renders the order invalid. By analogy with search warrant law, strict compliance with statutory conditions is required for orders that may authorise entry to residential premises. The Court's parens patriae jurisdiction may be invoked to appoint a tutor nunc pro tunc where a person under a financial management order has commenced proceedings without a tutor and the appointed manager declines to act.
