Copies of non-privileged documents held by solicitors are privileged where they were provided to the solicitors for the purpose of obtaining legal advice, applying the Propend Finance principle. A waiver argument based on inspection of documents produced by a different firm of solicitors will fail where there is no commonality between the two sets of documents.
